When the Federal Accountability Act came into force on December 12, 2006, it brought an important change to the Public Service Employment Act (PSEA) and, consequently, for ministerial staff. The previous priority appointment right for ministerial staff in the PSEA was repealed and replaced with a mobility provision.
Section 35.2 of the PSEA now entitles persons who have been employed for at least three years in the office of a minister or of a person holding the recognized position of Leader of Opposition in the Senate or Leader of the Opposition in the House of Commons, or in any of those offices successively, to participate in advertised internal appointment processes open to all employees in the federal public service. The entitlement to the mobility provision starts when the person ceases to be employed and lasts for one year. As a candidate in advertised internal appointment processes, former ministers' staff also have recourse rights to the Public Service Staffing Tribunal.
Persons wishing to request confirmation of their eligibility for the mobility provision must submit the "Request Form - Confirmation of Former Ministers' Staff Mobility Provision", which is available on the Web site of the Public Service Commission (PSC). If the person is eligible, the PSC will issue a letter of confirmation. The letter will serve as proof of eligibility when the former minister's staff applies for advertised internal appointment processes and must be submitted with each application. The PSC will provide eligible former minister's staff with access to the internal job postings in the public service.
